    Terms of Use

    Last updated: April 2026. These Terms of Use are entered into by and between you and DOMESTIKA, INC. ("DOMESTIKA", "Company", "we" or "us"), and govern your access to and use of the website www.domestika.org, our mobile applications and other interactive properties that DOMESTIKA owns and operates (collectively, the "Site"), as well as all associated services, features and content (the "Services"). Our Privacy Policy is incorporated by reference into these Terms of Use.

    1. Introduction.

    1.1. DOMESTIKA, INC ("DOMESTIKA", "Company", "we" or "us") offers you its Services (as described below) through its website (www.domestika.org), its mobile applications and other interactive properties that DOMESTIKA owns and operates (collectively, the "Site"), subject to the following Terms of Use. On the Site, users can access courses, post photographs, images and videos, share comments, opinions and ideas, promote their work and participate in contests and promotions. The Services include any service or content that DOMESTIKA makes available to you, as well as any material displayed, transmitted or performed on the Site.

    1.2. Acceptance of the Terms of Use.

    These Terms of Use, together with any documents incorporated by reference, govern your access to and use of the Services, whether as a guest or as a registered user. By using the Services, you accept these Terms of Use and our Privacy Policy. If you do not agree, you must stop using the Services. If you use the Services on behalf of a company, that company also accepts these Terms of Use.

    1.2 bis. EEA/UK/Switzerland Consumers.

    If you are a consumer and reside in the EEA, the United Kingdom or Switzerland, these Terms do not limit the mandatory rights granted to you by consumer protection laws. In the event of a conflict, such mandatory provisions shall prevail and any clause that contravenes them shall be interpreted in accordance with them.

    1.3. Changes to the Terms of Use.

    We may revise and update these Terms of Use from time to time. Changes will be posted indicating the date of the last update. We may also notify you through other reasonable means, in accordance with applicable law. Changes motivated by legal reasons or by new features will be effective immediately. All other changes will take effect fourteen (14) days after their publication. Continued use of the Services after publication constitutes acceptance of the changes.

    1.4. AI Tutor.

    As part of the Services, DOMESTIKA makes available to the user a conversational assistance feature based on artificial intelligence (the "AI Tutor"), which constitutes a general-purpose artificial intelligence system designed to generate responses, recommendations, summaries and other content based on queries, content and data provided by the user. The use of the AI Tutor is optional. This system is not designed to make decisions with legal effects or to replace professional advice of any kind. By using the AI Tutor, the user authorises the processing of their data in accordance with these Terms of Use, the Privacy Policy, Section 27 (Privacy and Data Protection) and Section 28 (AI Tutor Transparency and Security). DOMESTIKA will comply with the transparency, security and governance obligations applicable under current artificial intelligence legislation. DOMESTIKA does not guarantee the accuracy, completeness or suitability of the results generated by the AI Tutor.

    1.5. Types of Content in the Services.

    The Services may contain different types of content:

    1. User Content ("User Content"): any content that users upload, post, transmit or share through the Services, including text, images, videos, audio, comments, projects, voice samples or other materials.
    2. Platform Content ("Platform Content"): content provided directly by DOMESTIKA or its licensors, including courses, educational materials, interfaces, software, technological tools, designs, databases and artificial intelligence models.
    3. Generated Content ("Generated Content"): content generated wholly or partially by automated tools or artificial intelligence systems available in the Services, including AI Tutor Outputs and content generated through artificial intelligence features. Unless expressly stated otherwise in these Terms of Use: users retain ownership of their User Content. DOMESTIKA retains the rights over the Platform Content; and the use of Generated Content is governed by the terms set out in these Terms of Use.

    2. Access to the Services and Account Security.

    2.1. Access to the Services.

    DOMESTIKA may modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice, without liability to you or to any third party. However, in the event of planned interruptions of significant duration that affect essential functionalities of the Services, DOMESTIKA will endeavour to notify affected users in advance through available communication channels (email or platform notice), except in cases of technical urgency, security or legal compliance requiring immediate action. Access to AI features may vary by jurisdiction, user profile, legal requirements or security reasons. We may introduce security measures, filters, age controls or reasonable usage limitations to prevent misuse. You are responsible for ensuring that your use of the Services is lawful in your country of residence. The Services can be accessed from anywhere in the world, but this does not mean they are fully available in all countries or in all languages, nor that User Contributions are lawful in your jurisdiction. DOMESTIKA may block access to certain Services in certain countries. The Services are available only to users aged 16 and over. If you are not of the age of consent required to use online services in your place of residence, you must not access the Services; we encourage you to invite a parent or legal guardian to open an account and help you access appropriate content. If we discover an account that breaches these rules, we will terminate it. We reserve the right to disable any username, password or other identifier at any time, in our sole discretion, for any reason, including breach of these Terms of Use.

    2.2. Registration.

    Access to certain Services may require registration and the provision of truthful, accurate, current and complete information, which you must keep up to date. If you provide any information that is untrue, inaccurate, not current or incomplete, or if DOMESTIKA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, DOMESTIKA has the right to suspend or terminate your account and to deny you current or future use of the Services (or any part thereof). The use of interactive features is governed by our Privacy Policy.

    2.3. Account Security.

    If you choose, or we provide you with, credentials as part of our security procedures, you must treat them as confidential and not disclose them to third parties. Your account is personal and you are responsible for all activities carried out from it. You must notify us of any unauthorised access or security incident. Do not share credentials, content or sensitive data unless strictly necessary for your query. You must be particularly cautious when accessing your account from a public or shared computer so that others cannot view or record your password or other personal information. DOMESTIKA shall not be liable for any act or omission on your part, including any damages of any kind resulting from such acts or omissions. Review and, where applicable, remove or anonymise personal or confidential data before submitting it to the AI Tutor.

    3. User Conduct.

    3.1. Use of the Service.

    The Site and the Services are offered for your personal and non-commercial use, unless expressly authorised in writing. You shall not use the Service as a permanent repository; you must keep copies of your content. We have no obligation to retain any content you have posted for any period of time beyond what applicable law requires.

    3.2. Prohibited Uses.

    You agree not to use the Services for any unlawful purpose or any purpose prohibited by these Terms of Use. Nor shall you use them for any other purpose that DOMESTIKA has not reasonably contemplated. The following are listed by way of example only and without limitation. You agree not to use the Services:

    1. In a manner that violates any applicable local, regional, national or international law or regulation.

    2. To (or to attempt to) abuse, harm, harass, threaten, impersonate or intimidate any person.

    3. To send, knowingly receive, upload, post, download, use or reuse any material or content that:

      1. contains unlawful, defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable material;
      2. promotes sexually explicit or pornographic material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
      3. infringes any patent, trademark, trade secret, copyright or other intellectual property rights of any person or entity;
      4. violates the legal rights of third parties (including rights of publicity and privacy) or contains material that could give rise to civil or criminal liability under applicable law;
      5. is likely to deceive any person;
      6. promotes, proposes or encourages any unlawful activity or act;
      7. annoys, inconveniences or causes unnecessary anxiety, or is likely to anger, inconvenience, alarm or annoy any other person;
      8. impersonates any person or misrepresents your identity or affiliation with any person or organisation;
      9. involves unauthorised commercial activities or offerings, such as contests, sweepstakes, sales promotions, barter or advertising campaigns; or
      10. gives the impression that it emanates from or is endorsed by DOMESTIKA, if this is not the case.
    4. To transmit or procure the sending of any unsolicited advertising or promotional material, including "junk mail", "chain letters" and "spam". You may not also collect or harvest email addresses or other contact information of other users by electronic or other means for the purpose of sending unsolicited communications.

    5. To impersonate or attempt to impersonate DOMESTIKA, a DOMESTIKA employee, another user or any other person or entity. This prohibition includes, without limitation, the use of email addresses or screen names associated with any of the foregoing. You may not also misrepresent your affiliation with any person or entity.

    6. To create multiple accounts for the purpose of manipulating (i.e., through "Like" votes) in favour of or against a user's projects. It is also prohibited to exaggerate or artificially alter "Like" votes, comments or other metrics. You may not give or receive money or other compensation in exchange for "Like" votes. You may not also participate in any other organised initiative that artificially modifies the results of the Services in any way.

    7. To engage in any other conduct that restricts or inhibits any person from using or enjoying the Services. This restriction also covers any conduct that, as we may determine, could harm DOMESTIKA or the users of the Services, or expose them to liability. In addition to the foregoing prohibitions, you shall not use the AI Tutor to:

    8. enter or request information intended to infringe the rights of third parties or the law;

    9. upload or attempt to infer sensitive data of third parties (health, biometric, sexual orientation, religious beliefs, political opinions, trade union membership, data of minors) without a legal basis and applicable safeguards;

    10. circumvent security measures or generate harmful, misleading, discriminatory content or content that encourages unlawful activities;

    11. make decisions based solely on automated processing with legal or similar effects without adequate human review;

    12. create or disseminate "deepfakes" or synthetic content that identifies natural persons without their authorisation or without clear labelling as AI-generated content;

    13. develop or use facial/biometric recognition features, inference of sensitive attributes or mass surveillance;

    14. extract or "scrape" personal data on a large scale without a legal basis and without respecting the rights of data subjects;

    3.3. Other Technical and Conduct Restrictions.

    In addition, you agree not to:

    1. Circumvent any measures we may take to prevent or restrict access to the Services.
    2. Use the Services in any manner that could disable, overburden, damage or impair the Services, or interfere with any other party's use of the Site, including their ability to engage in real-time activities through the Site.
    3. Use any robot, spider or other automatic device, process or means to access the Services for any purpose, including monitoring or copying any material from the Services.
    4. Use any manual process to monitor or copy any material from the Services, or for any other purpose not expressly authorised in these Terms of Use, without our prior written consent.
    5. Use any device, software or routine that interferes with the proper functioning of the Services.
    6. Introduce viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.
    7. Obtain or attempt to obtain materials or information through any means not intentionally made available or provided through the Service.
    8. Attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Services, the server on which the Services are stored, or any service, computer or database connected to the Services or to other users' private accounts.
    9. Attack the Services through a denial-of-service attack or a distributed denial-of-service attack.
    10. Otherwise attempt to interfere with the proper functioning of the Services. DOMESTIKA shall have the right to remove any content that infringes the Terms of Use or is otherwise objectionable. If you suspect that these Terms of Use have been violated (other than copyright infringement notices, as described below), please contact us through our web form.

    3.4. Data Extraction and Use for Model Training.

    Unless expressly and previously authorised in writing by DOMESTIKA, the following is prohibited:

    1. systematically collecting, downloading, extracting or reproducing content from the Services for the purpose of creating databases, structured files or data collections;
    2. using any content obtained from the Services to train, develop, improve or evaluate external artificial intelligence systems, machine learning or algorithmic models;
    3. reproducing or exploiting in an automated manner courses, educational materials, creative content or platform data for commercial or research purposes;
    4. performing scraping, data mining or automated extraction of information that may affect the operation, security or integrity of the Services. DOMESTIKA may take technical and legal measures to prevent such practices, including access restrictions, IP address blocking or legal action. This prohibition includes the use of content from the Services as datasets for the training, development or evaluation of third-party artificial intelligence systems, even when such content has been previously downloaded or is publicly accessible.

    3.5. Acceptable Use Policy.

    The use of the Services is also governed by DOMESTIKA's Acceptable Use Policy ("Acceptable Use Policy"), which describes in greater detail certain prohibited practices related to the use of the Services, including system abuse, scraping, fraud, metric manipulation or misuse of content. Such policy forms an integral part of these Terms of Use and may be consulted on the DOMESTIKA website. Breach of the Acceptable Use Policy may result in, among other measures: content removal, restriction of features, suspension or cancellation of accounts, or any other reasonable measure necessary to protect the security and integrity of the Services.

    4. Disputes Between Users.

    Your interaction with other users is your sole responsibility. DOMESTIKA may intervene but is under no obligation to do so.

    5. Intellectual Property.

    5.1. DOMESTIKA's Intellectual Property Rights.

    The Services and their content (including, without limitation, information, software, text, displays, images, videos, audio, design, selection and arrangement) are owned by DOMESTIKA, its licensors or other providers of such materials, and are protected by intellectual property laws. A limited, non-exclusive and non-transferable licence is granted to access and view content in accordance with these Terms. Except for the limited licence mentioned above, no right, title or interest in the Services or any content thereof is transferred to you, and DOMESTIKA reserves all rights not expressly granted. DOMESTIKA may revoke your licence at any time and in its sole discretion. You must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store or transmit any of the materials from our Services. The name and logo of DOMESTIKA, as well as all related names, logos, product and service names, designs and slogans, are trademarks of DOMESTIKA, its affiliates or licensors. You must not use these trademarks without our prior written permission. You must not remove or alter any copyright, trademark or other proprietary rights notice from any material on the Site.

    5.2. User Contributions.

    You shall retain all rights and ownership in your photographs, images, videos, sounds, voice samples or any other content or materials that you upload through the Services or share with other users or recipients (collectively, "User Contributions"). DOMESTIKA does not claim any ownership rights over your User Contributions. However, by providing or uploading User Contributions, you grant DOMESTIKA, its affiliates and service providers (and their respective licensors, successors and assigns) a non-exclusive, worldwide, royalty-free, fully paid-up, transferable and sublicensable licence to copy, reproduce, store, distribute, modify, adapt, publicly communicate and display, publish and use such User Contributions for the purpose of operating, maintaining, improving and providing the Services. DOMESTIKA will give you appropriate credit where reasonable. You also grant other users, visitors and DOMESTIKA instructors the right to share such Contributions through the features integrated into the Services. To terminate this licence, you may remove your User Contributions from the Services. DOMESTIKA will endeavour to remove the content within a reasonable time, without prejudice to cached copies or residual references that may temporarily remain. You should know and agree that any questions, comments, suggestions, ideas, opinions or other information pertaining to the Services ("Submissions") will not be confidential, and may be used by DOMESTIKA without restriction for any purpose, commercial or otherwise, without acknowledgement or compensation. You represent and warrant that:

    1. you own or control all rights in your User Contributions and have the right to grant the licences set out above; and

    2. such User Contributions comply with these Terms of Use. You are solely responsible for the legality, reliability and appropriateness of your User Contributions. DOMESTIKA is not liable for the content or accuracy of User Contributions posted by users. For the provision of the service and the operation of the AI Tutor, DOMESTIKA may process User Contributions and prompts submitted by the user for the following purposes:

    3. providing the functionalities requested by the user;

    4. ensuring the security, integrity and proper functioning of the Services;

    5. improving the quality and performance of systems, including artificial intelligence systems. The use of User Contributions and prompts for the training, development or improvement of artificial intelligence systems shall only take place in the following cases: where the data do not contain personal data or have been duly anonymised in an irreversible manner; or where the user has given explicit, specific and separate consent for such processing. The user may manage and revoke at any time their consent to the use of their data for the training of artificial intelligence models. To this end, DOMESTIKA makes available to the user the AI Data Preferences panel described in Section 27.8, which constitutes the main mechanism for the exercise of this right. Through this panel, the user may, among other options:

    6. exclude their User Contributions and prompts from use for the improvement and training of artificial intelligence models;

    7. manage their conversation history with the AI Tutor; and

    8. revoke any consent previously given for the processing of their data for AI training purposes, without such revocation affecting the lawfulness of processing based on consent prior to its withdrawal.

    The revocation of consent shall take effect within a reasonable maximum period from its exercise. DOMESTIKA will cease using User Contributions for AI training purposes once the request has been processed, without prejudice to minimum retentions necessary due to legal obligations, security or fraud prevention, as set out in Section 27.6. In relation to case (ii) above, the user's consent shall be deemed given and may be managed and revoked through the AI Data Preferences panel under Section 27.8 of these Terms of Use. Under no circumstances shall personal data included in User Contributions or prompts submitted to the AI Tutor be used for the training of general-purpose artificial intelligence models without the user's prior consent. DOMESTIKA will apply data minimisation measures, pseudonymisation where possible and will respect the user's privacy preferences in relation to the use of their data in artificial intelligence systems.

    5.3. Copyright Complaints and Counter-Notices.

    DOMESTIKA respects the intellectual property of third parties and we ask our users to do the same. We have adopted the following policy regarding copyright infringement in connection with the Services in accordance with the Digital Millennium Copyright Act ("DMCA"). If you believe in good faith that the Site hosts content that infringes your copyright, we ask that you notify us through a notice to our copyright agent at the email address copyright@domestika.org or by post to Copyright Agent, 2001 Addison St. Suite 300 Berkeley, CA 94704, USA. Your notice must include ALL of the following information: Identification of the copyrighted works that are the subject of the copyright infringement claim. Identification of the material that is the subject of the infringement claim, and reasonably sufficient information for us to locate the material (i.e., the URL). Contact information so that we can reach you (address, telephone number and email address). A statement by you that you believe in good faith that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner. Before filing an infringement notice, carefully consider whether the use of the copyrighted material in question is protected by the doctrine of "fair use", as you may have to bear costs and attorneys' fees if you file a takedown notice when, in fact, no copyright infringement has occurred. DOMESTIKA will respond diligently to valid DMCA requests. In all cases, if you do not hear from us within 14 days of filing the complaint, please contact us through the web form and we will respond as soon as possible. After removing access to the material pursuant to a valid DMCA notice, DOMESTIKA will promptly notify the user responsible for the allegedly infringing material that access to the material has been removed or disabled. DOMESTIKA reserves the right, in its sole discretion, to immediately terminate the account of any member who receives repeated DMCA notices. If you believe that DOMESTIKA has removed or disabled access to your content as a result of an improper copyright infringement notice, please send our copyright agent a written counter-notice containing the following information: A description of the improperly removed work, together with your username and the location on the Site where the content was displayed before it was removed or disabled. Contact information so that we can reach you (address, telephone number and email address). A statement, under penalty of perjury and signed by you, that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification. A statement consenting to the jurisdiction of the Southern District of New York and accepting service of process from the person who filed the alleged infringement notice. Upon receipt of a valid counter-notice, DOMESTIKA will forward it to the party that filed the original DMCA notice. That party (or the copyright holder it represents) will have ten (10) days to notify us that it has filed a legal action regarding the allegedly infringing material. If DOMESTIKA does not receive such notice within ten (10) days, we may restore the material to the Services.

    5.4. AI Tutor Outputs and Content Generated by Artificial Intelligence.

    Unless otherwise indicated, and without prejudice to the rights of third parties over underlying content, the user may use the Outputs generated by the AI Tutor and content generated through artificial intelligence features available in the Services for personal purposes. The use of such Outputs for commercial purposes, which in any case shall be at the user's sole responsibility, shall only be permitted when:

    1. it takes place within the framework of the user's own projects or projects of third parties for which the user legitimately acts, that do not involve the direct resale, sublicensing or autonomous exploitation of the Outputs as a main product; and
    2. such use does not infringe the rights of third parties or applicable regulations. By way of illustration and without being exhaustive: -Permitted uses: incorporating Outputs into the user's own commercial presentations, using them as support for creating the user's company marketing materials, including them in internal work reports, using them as a reference or inspiration for the user's own creative projects. -Uses not permitted without an additional licence: creating and selling a collection of Outputs as a main product (for example, a book of AI-generated illustrations), offering a service to third parties that mainly consists of generating Outputs through the AI Tutor, sublicensing or reselling Outputs as standalone assets, using Outputs as the main content of a competing platform. Should the user wish to use the Outputs as part of products, services or content intended for direct or large-scale commercialisation, such use may be subject to additional terms, limitations or specific licences that DOMESTIKA may establish and communicate at any time. The user is responsible for verifying that the use of the Outputs does not infringe the rights of third parties, as well as for obtaining, where applicable, the necessary authorisations for their use, reproduction or exploitation. The Outputs may be wholly or partially based on third-party content, public data or contributions from other users; DOMESTIKA does not guarantee their originality or that they are free from third-party rights. DOMESTIKA may offer extended commercial licences or specific terms for certain uses in the future.

    5 bis. Content Moderation and Infringement Notification.

    DOMESTIKA maintains mechanisms designed to detect, review and remove content that infringes applicable law or these Terms of Use. These mechanisms may include:

    1. automated review using technological tools;
    2. human review by the moderation team;
    3. reports or notifications submitted by users or third parties.

    Users may report content that is allegedly unlawful or infringing through the mechanisms enabled in the Services. Upon receipt of a valid notification, DOMESTIKA may take reasonable measures, which may include:

    1. removal or disabling of access to the content;

    2. restriction of its visibility;

    3. suspension or cancellation of the account involved. When significant moderation measures are taken (such as content removal, restriction of visibility or account suspension), the affected user will be informed of the reasons for such decision and may submit an appeal free of charge through the appeal form available in the Services or by email to hello@domestika.org, indicating in the subject line "Moderation Appeal". The appeal must be submitted within six (6) months from the notification of the initial decision. DOMESTIKA will review the appeal and communicate its reasoned decision to the user within a maximum period of ten (10) business days from receipt of the appeal. Possible outcomes of the appeal include:

    4. restoration of the content or account, if it is determined that the initial decision was erroneous;

    5. confirmation of the moderation decision with an explanation of the reasons; or

    6. application of proportionate alternative measures. If the user is not satisfied with the resolution of their appeal and resides in the European Union, they may refer the matter to a certified out-of-court dispute resolution body pursuant to Regulation (EU) 2022/2065 (Digital Services Act). DOMESTIKA may periodically publish aggregated information on content moderation activities for transparency purposes. Beginning of form End of form

    6. Monitoring and Enforcement.

    DOMESTIKA may reasonably monitor and audit the use of the Services to detect abuse, unlawful content, evident biases, security risks or breaches of these Terms, and implement rate limits, security filters, temporary blocks or termination in the event of abusive use. DOMESTIKA has the right to:

    1. Remove any User Contribution or Submission for any or no reason, and in our sole discretion.

    2. Take any action with respect to any User Contribution that we deem necessary or appropriate, in our sole discretion, including where we believe that such User Contribution violates the Terms of Use, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Services or the public at large, or could create any liability for DOMESTIKA.

    3. Disclose your identity or other information about you to any third party who claims that material you have posted infringes their rights, including their intellectual property or privacy rights.

    4. Take appropriate legal action, including, without limitation, referral to law enforcement, for any illegal or unauthorised use of the Services.

    5. Terminate or suspend your access to the Services, in whole or in part, for any or no reason, including, without limitation:

      1. any breach of these Terms of Use;
      2. non-payment of any amount you owe;
      3. the filing of fraudulent chargeback requests;
      4. if we suspect that you are involved in fraudulent or illegal activities; or
      5. for any other reason, in our sole reasonable discretion. You agree that any termination of your access to the Service under any provision of these Terms of Use may take effect without prior notice and you acknowledge and agree that DOMESTIKA may immediately deactivate or delete your account, as well as all related information and account files, or bar any further access to such files or to the Service. DOMESTIKA shall not be liable to you or to any third party for any termination of your access to the Service. YOU WAIVE AND RELEASE THE COMPANY AND ITS AFFILIATES, LICENSORS AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES OR AS A RESULT OF THEIR INVESTIGATIONS, AND FROM ANY ACTION TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

    7. Reliance on Information Posted.

    The information presented on or through the Services is of a general nature. Content generated by artificial intelligence, such as AI Tutor responses, is produced automatically and may contain errors, omissions, biases or inaccuracies. They should be considered informational, do not constitute professional advice and should be verified before relying on them. DOMESTIKA makes reasonable efforts to improve the quality, safety and reliability of such content, but does not guarantee its accuracy, completeness or suitability for specific purposes. The user is responsible for assessing the suitability of the Outputs before use, especially in professional, commercial or sensitive contexts, and for verifying the information where necessary.

    8. Linking to the Services and Social Media Features.

DOMESTIKA is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements available in connection with social media services. DOMESTIKA enables these features merely as a convenience, and the integration or inclusion of such features does not imply any endorsement or recommendation. We reserve the right to withdraw linking permission without notice. We may disable all or any social media features and any links at any time without notice, in our sole discretion.

    9. Links from the Services.

    If we or third parties provide links to other third-party sites and resources, these links are provided solely for your convenience. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked from the Services, you do so entirely at your own risk and subject to the terms and conditions of use for such websites. DOMESTIKA reserves the right to remove any link provided by third parties on the Services. 9.1. YouTube API Services. Certain features of our Service incorporate YouTube API Services to display and recommend video content. By using our Service, you agree to be bound by the YouTube Terms of Service, available at: https://www.youtube.com/t/terms. Continued use of any feature that displays YouTube content constitutes your acceptance of those terms.

    10. Geographic Restrictions and Sanctions.

    You represent that you are not in countries or on lists sanctioned by the U.S. nor are you a person or entity subject to restrictions. You must ensure that you (as an individual or as a representative of any entity on whose behalf you use the Services) are not located in, or a resident of, any country subject to current U.S. sanctions or trade embargoes (such as Cuba, Iran, North Korea, Sudan, Syria or the Crimea region of Ukraine). You must also ensure that you are not any person or entity whose name appears on any specially designated national or denied parties list maintained by the U.S. government. Should your situation change and you become subject to these restrictions, you must notify us within 24 hours and we shall have the right to terminate any further obligation to you, with immediate effect and without any liability to you. We may apply geoblocking or availability restrictions on the AI Tutor to comply with local legal or regulatory obligations (for example, age requirements or AI transparency requirements).

    11. Fees.

    A fee is required to use the online courses and other Services (such as DOMESTIKA PLUS) that DOMESTIKA offers. You agree to pay the fees for the content you purchase and authorise DOMESTIKA to charge you for the Services using the payment method you select. Fees will be charged whether or not you use the purchased Services. You are responsible for paying all fees charged by DOMESTIKA on time, as well as applicable taxes. We reserve the right to disable or remove access to any content for which we have not received adequate payment. Fees may vary based on your location and other factors. If you are logged into your account, the currency you see selected will be based on your location at the time you created the account. However, the final fees charged to you will always be calculated in USD; therefore, such final fees may vary depending on the prevailing exchange rates offered by our payment providers. You will provide DOMESTIKA with your credit card or other payment instrument information. You represent and warrant that (a) this information is true, accurate, current and complete, and you are authorised to use this payment instrument, and (b) you will promptly maintain and update this information so that it remains true, accurate, current and complete. You agree that DOMESTIKA may update your payment methods with information provided to us by our payment service providers and you authorise us to continue charging the applicable fees to your updated payment method. DOMESTIKA reserves the right, at any time, to change any fees or to begin charging for any Services that were previously free, in its sole discretion.

    12. Refunds.

    Our refund policy distinguishes between one-time payments for courses and DOMESTIKA PLUS (see section 13 for more information on DOMESTIKA PLUS). However, the following guidelines apply in both cases:

    1. Refunds are not available for accounts that breach these Terms of Use or that, in DOMESTIKA's sole and absolute discretion, are objectionable for any other reason;
    2. if DOMESTIKA determines that you are misusing our refund policy, we reserve the right to suspend or terminate your account and to deny or restrict any current or future use of the Service without issuing any refund;
    3. to request a refund, please contact us through our web form;
    4. DOMESTIKA will apply your refund to your original payment method. In the event that your payment method does not support refunds or you have blocked or deactivated your card, DOMESTIKA shall not be obligated to process the refund;
    5. in the event that you delete your profile, no refund can be made (where applicable);
    6. unfortunately, at this time, we cannot offer partial refunds for your purchases.

    If within the first 14 days after purchasing a course you are not satisfied with it, DOMESTIKA will refund the full amount of your purchase and will subsequently terminate your access to the course. We will not be able to process any refund requested after this 14-day period. Due to possible fluctuations in the exchange rate between your local currency and the US dollar, the refunded amount may be slightly higher or lower than the amount you originally paid. In addition to the foregoing, if you purchase a course, or any other paid service, through a mobile device or a third-party digital store (for example, purchases made through the Apple App Store or Google Play App Store), the refund policy in effect at that third-party digital store shall apply, unless DOMESTIKA explicitly provides otherwise. Except as DOMESTIKA may explicitly provide otherwise, the third-party digital store shall be solely responsible for processing refunds in accordance with its refund policy and DOMESTIKA shall have no obligation to process any refund. DOMESTIKA disclaims any liability related to the refund policy of any third-party digital store or to the compliance or non-compliance with such policy by such third parties.

    13. Terms Applicable to Domestika Plus.

    This section addresses the additional terms that apply to your participation in the DOMESTIKA PLUS recurring purchase system. By using DOMESTIKA PLUS, you accept the additional terms in this section. DOMESTIKA PLUS Recurring Purchase System: Depending on the recurrence chosen (monthly or annual), you will automatically receive the corresponding credits (1 monthly credit or 12 annual credits) at the beginning of each period. If you started your subscription with a trial period, please see the relevant section below. Each credit shall remain valid until the earlier of the following dates:

    1. 12 months from the start of the subscription period in which it was granted, or
    2. the expiration date of your Plus subscription.

    Unused credits after such periods shall be cancelled. Each regular course or "guided course" requires one (1) credit; basic courses require two (2) credits; and specialisation courses require three (3) credits. During your participation in DOMESTIKA PLUS, we also grant you a limited, non-exclusive and non-transferable licence to access and view the content included in the plan. The specific plan you purchase or renew determines the scope, features, terms and price. Your participation will continue until it is cancelled. You may not transfer, assign or share with third parties the credits or any other benefit of DOMESTIKA PLUS. Fees, Payments and Automatic Renewal: The price of DOMESTIKA PLUS will be indicated at the time of purchase (for the monthly option, such fee will refer to 1 credit and for the annual option, the fee will refer to 12 credits, in addition to other ancillary benefits). You must pay the DOMESTIKA PLUS fee through the payment methods that DOMESTIKA offers. By participating in the DOMESTIKA PLUS recurring purchase system, you authorise DOMESTIKA to maintain your account information and to charge your account automatically and on a recurring basis when the next recurring purchase is due, without any further action required on your part. If DOMESTIKA cannot complete the charge for the DOMESTIKA PLUS fee, it reserves the right to split the outstanding amount into smaller charges and continue attempting to collect until the total amount is completed. In the event that the renewal date arrives with an outstanding payment (and provided the user has not cancelled the automatic renewal), DOMESTIKA may choose to cancel the renewal or accept it, but will continue attempting to collect the outstanding amount. DOMESTIKA also reserves the right to suspend your access to DOMESTIKA PLUS if there are outstanding payments. DOMESTIKA may change the price for future recurring purchases. In that case, DOMESTIKA will notify you in writing. Price changes will be effective on the next recurring purchase after the date of such changes. If you do not agree with the price change, you have the right to reject the change by cancelling your participation in DOMESTIKA PLUS before the next recurring purchase is generated. Free Trials: Your DOMESTIKA PLUS subscription may begin with a free trial, the duration of which will be specified at the time of enrolment. DOMESTIKA will determine whether you meet the requirements for the trial and may limit its validity, access and duration at its sole discretion. If you sign up for a free trial, the refund period (if applicable) will begin on the first day of such period. Before starting the trial, you must provide a payment method. You will receive 1 Plus credit from the start of the trial period. After the trial ends, the subscription will automatically continue in accordance with the selected billing cycle (monthly or annual) and the corresponding fee will be charged, granting the remaining credits (11 credits for an annual subscription or 1 credit for a monthly subscription). You may cancel at any time from your profile. Cancellation will be effective at the end of the trial period. If you cancel before the trial ends and have not redeemed the credit received, it will be automatically cancelled. Cancellation and Refunds: Your participation in DOMESTIKA PLUS will continue until it is cancelled. You may cancel your participation in DOMESTIKA PLUS through our website at any time before the next recurring purchase is generated (or before the free trial period ends). Cancellation will only take effect at the end of the period associated with your selected recurring purchase system, and you will retain access to the services included in that system until the conclusion of that period. If you are on a free trial, cancellation will take effect immediately and you will lose access to any unused credits. If you cancel your participation in DOMESTIKA PLUS before the new recurring purchase is generated (or before the end of your trial period), it will not be processed and you will not be charged. However, if the recurring purchase has already been generated, it will not be refunded. In this regard, we will not refund any purchase that was generated before you cancelled your participation in DOMESTIKA PLUS. As you can enjoy our Services immediately after registering for DOMESTIKA PLUS, DOMESTIKA does not offer a 14-day right of withdrawal for DOMESTIKA PLUS. You acknowledge that by registering for DOMESTIKA PLUS, you agree to the immediate supply of digital content and therefore waive your right of withdrawal.

    13.1. Terms Applicable to Domestika Lives.

    Domestika Lives is a service that offers live sessions between Domestika Plus users and selected Domestika instructors ("Lives"), focused on creative topics. These sessions may include demonstrations, talks, interviews or interactive real-time classes. Access and Use of the Service: Access to live sessions is limited, non-transferable and requires prior registration. To join, users must register in advance and, depending on the terms of each session, may need to redeem a Plus credit, make a one-time payment or complete a free registration. Domestika reserves the right to modify the schedule, cancel or reschedule sessions depending on availability or operational needs. Attendance requires an active Domestika Plus subscription (including trial periods). If you cancel your subscription before the session, you will lose access to it. However, on a temporary and promotional basis, Domestika may offer free access to certain sessions to all users, regardless of their subscription. Such access will be limited to the specific sessions for which they have registered and will not include recordings or additional benefits, unless expressly indicated in the session description. If the service begins requiring a subscription, credits or payment, these users will not retain access to new sessions unless they meet the applicable conditions. In the event of rescheduling, the free access of already confirmed registrations will be honoured. Language and Subtitles: Sessions will be broadcast in a specific language, indicated on the registration page. Domestika may offer subtitles or real-time translations; their availability will also be shown there when applicable. Cancellations and Refunds: In the event of cancellation by Domestika, users will have the option to change their registration to another available session in the Lives calendar. If the live session was acquired as part of a course purchase, it may be exchanged for another available session in the current calendar. No refunds or credits will be issued in this case. If the session was acquired independently (i.e., not linked to a course), the user may choose between registering for another available session or requesting the return of the credit or payment made. No refunds will be issued if the user does not attend the session. Intellectual Property and Participation: Sessions may be recorded by Domestika for future distribution or reuse. By registering and participating, users consent to the use of their image, name or voice in such recordings. Shared content is protected by copyright and may not be recorded, distributed or reused by users without Domestika's express authorisation. Limitations and Modifications of the Service: Domestika may modify at any time the terms of access, availability or operation of Domestika Lives without prior notice, due to technical improvements, changes in the educational offering or force majeure.

    14. Gift Cards.

    DOMESTIKA or our partners may offer gift cards that can be used to purchase courses applicable to the terms of your gift card. To redeem your gift card, you must have or create a valid DOMESTIKA account. DOMESTIKA gift cards may not be resold without the express written authorisation of DOMESTIKA, are non-refundable and may not be exchanged for cash, or any cash equivalent, except as required by law. Gift cards offered by partners are subject to that partner's policy. DOMESTIKA is not responsible for lost or stolen gift cards, or for their unauthorised use. DOMESTIKA may reject or cancel a gift card and request another form of payment if it suspects the gift card may have been stolen or used fraudulently. It may also take additional measures. The use of gift cards that in any way assert or imply that DOMESTIKA has endorsed or sponsored any person, website, company, product or service, or that any such person, website, company, product or service has any affiliation with DOMESTIKA, is strictly prohibited without DOMESTIKA's prior written approval. Gift cards that have been purchased from unauthorised resellers, sellers or distributors shall not be deemed valid and DOMESTIKA shall not be responsible therefor.

    15. Disclaimer of Warranties.

    You should understand that we cannot and do not guarantee that files available for download from the Internet or the Services will be free of viruses or other destructive code. You should implement sufficient procedures and checkpoints to satisfy your particular requirements for antivirus protection and accuracy of data input and output. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE SITE OR ANY OF THE SERVICES, OBTAINING ITEMS THROUGH THE SERVICES OR DOWNLOADING ANY MATERIAL POSTED ON THE SITE OR ON ANY WEBSITE LINKED TO IT. YOUR USE OF THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. Nothing in the foregoing affects warranties that cannot be excluded or limited under applicable mandatory consumer protection laws.

    16. Limitation of Liability.

    TO THE FULLEST EXTENT PROVIDED BY LAW, DOMESTIKA, ITS AFFILIATES OR ITS LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS SHALL NOT BE LIABLE IN ANY EVENT FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE OR SUCH OTHER WEBSITES, INCLUDING THOSE RELATED TO THE AI TUTOR AND ITS OUTPUTS, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, PROFITS, BUSINESS OPPORTUNITIES, ANTICIPATED SAVINGS, USE, GOODWILL OR DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. DOMESTIKA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION SHALL NOT IN ANY EVENT EXCEED THE AMOUNT YOU HAVE PAID TO DOMESTIKA IN THE LAST SIX (6) MONTHS OR ONE HUNDRED DOLLARS (100 USD), WHICHEVER IS GREATER. Nothing in this Section 16 excludes or limits liability for death or personal injury caused by negligence, wilful misconduct or fraud, nor does it affect the non-waivable rights of consumers under applicable law.

    17. Indemnification.

    You agree to defend, indemnify and hold harmless DOMESTIKA and its affiliates, licensors and service providers, as well as their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns, from claims arising from your breach of these Terms or use of the Service, including User Contributions, and unauthorised uses.

    18. Governing Law and Jurisdiction.

    All matters relating to the Services and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of New York, USA, without giving effect to any choice or conflict of law provision or rule. Pursuant to Section 19, any litigation, action or proceeding shall be brought exclusively in the Southern District of New York or in the courts of the State of New York, in each case located in the County of New York, although we retain the right to bring any litigation, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. If you are a consumer residing in the EEA, the United Kingdom or Switzerland, this choice of law and forum shall not deprive you of the protection afforded by the mandatory provisions of your place of residence, and you may bring actions before the courts of your domicile.

    19. Dispute Resolution (Binding Arbitration; Class Action Waiver).

    General. In the interest of resolving disputes between you and DOMESTIKA in the most expedient and cost-effective manner, you and DOMESTIKA agree that any dispute arising out of, or related in any way to, these Terms of Use, your use of the Site or the Services, or the purchase, receipt, order or use of any course shall be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration involves a neutral arbitrator instead of a judge or jury; arbitrators can award the same damages and relief as a court. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. Exceptions. Notwithstanding the provisions of the foregoing section, nothing in these Terms of Use shall be deemed a waiver of, or shall prevent, preclude or otherwise limit, the right of either party to: (a) seek enforcement action through the applicable federal, state or local agency where such action is available; (b) seek injunctive relief in a court of law; or (c) file suit in a court of law to assert a claim of intellectual property infringement. Arbitrator. Any arbitration between you and DOMESTIKA shall be governed by the Federal Arbitration Act of the United States, the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer-Related Disputes (collectively, the "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Terms of Use; the AAA will also administer the disputes. Notice; Process. A party intending to seek arbitration must first send a written notice of the dispute to the other party by U.S. Postal Service or by email ("Notice"). DOMESTIKA's address for notices is: 2001 Addison St., Suite 300, Berkeley, CA 94704, USA or legal@domestika.org. The notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). The parties will endeavour in good faith to resolve the claim directly, but if the parties do not reach an agreement within 30 days after receipt of the notice, you or DOMESTIKA may initiate arbitration proceedings. No Class Actions. YOU AND DOMESTIKA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and DOMESTIKA agree otherwise, the arbitrator may not consolidate the claims of more than one person or preside over any form of representative or class proceeding. Modifications to this Arbitration Provision. If DOMESTIKA makes any future change to this arbitration provision, other than a change to DOMESTIKA's address for notices, you may reject the change by sending written notice within 30 days of the date of the change to DOMESTIKA's address for notices, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, shall continue to govern any dispute between you and DOMESTIKA. Opt-Out Right for United States Users. If you reside in the United States, you have the right to opt out of the binding arbitration and class action waiver provisions set forth in this Section 19 by sending a written notice to DOMESTIKA within thirty (30) days of the date you first accepted these Terms of Use. Such notice must be sent by certified mail to 2001 Addison St., Suite 300, Berkeley, CA 94704, USA, or by email to legal@domestika.org, with the subject line "Arbitration Opt-Out Request". The notice must include:

    1. your full name;
    2. your email address associated with your DOMESTIKA account;
    3. your postal address; and
    4. a clear statement that you wish to opt out of binding arbitration and the class action waiver.

    If you exercise this opt-out right, all other terms of these Terms of Use shall remain in full force and effect. The exercise of this opt-out right shall not affect any prior or future business relationship with DOMESTIKA. European Union Consumers. If you are a consumer habitually resident in the European Union or the European Economic Area, the arbitration provisions of this Section 19 (including the class action waiver) shall not apply to the extent that they deprive you of the right to bring legal proceedings before the competent courts of the Member State of your domicile or to participate in representative actions pursuant to the legislation of your Member State transposing Directive (EU) 2020/1828. Nothing in this Section shall prevent you from submitting a dispute to an alternative dispute resolution (ADR) entity recognised pursuant to Directive 2013/11/EU (ADR Directive), or from filing a complaint through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. Arbitration Costs for Consumer Claims. If you are a consumer and your claim does not exceed ten thousand US dollars (10,000 USD), DOMESTIKA will pay the filing fees for the AAA arbitration, unless the arbitrator determines that the claim is frivolous or was filed for an improper purpose. In any event, each party shall bear its own attorneys' fees, unless applicable law provides otherwise. These waivers and arbitration shall not apply to the extent prohibited by law, nor to EEA/UK/Switzerland consumers where mandatory law provides otherwise.

    20. Limitation of Time to File Claims.

    ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SERVICE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED. European Union Consumers. If you are a consumer habitually resident in the European Union or the European Economic Area, the limitation period set out in this Section 20 shall not apply to the extent that it reduces the applicable legal limitation period under the mandatory rules of the Member State of your habitual residence.

    21. Waiver and Severability.

    No waiver by DOMESTIKA of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of DOMESTIKA to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

    22. No Third-Party Beneficiaries and Assignment.

    There are no third-party beneficiaries unless expressly provided. You may not assign these Terms without consent; DOMESTIKA may assign them without restriction.

    23. Entire Agreement.

    These Terms constitute the sole and entire agreement between you and DOMESTIKA regarding the Services and supersede all prior covenants, representations, warranties and agreements, both written and oral, relating to the Services.

    24. Time Zone.

    Unless otherwise indicated, all deadlines and schedules are based on UTC.

    25. Language.

    These Terms of Use are made available to you in several languages for your convenience. If you are a consumer habitually resident in Spain or another EU Member State, the version of these Terms in the official language of your country of habitual residence shall prevail in the event of a conflict with the English version, to the extent required by the mandatory consumer protection rules of your jurisdiction. In all other cases, you understand and agree that the English version shall prevail in the event of a conflict.

    26. Your Comments and Concerns.

    You may submit comments or support requests through our web form or to hello@domestika.org. If you are an EEA consumer, you may also access alternative consumer dispute resolution mechanisms and the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

    27. Privacy and Data Protection.

    27.1. Controller and Legal Bases.

    For the processing of personal data, DOMESTIKA acts as data controller pursuant to Regulation (EU) 2016/679 (GDPR), EEA, UK and Swiss regulations, and U.S. state privacy laws (including CPRA-California, VCDPA-Virginia, CPA-Colorado, CTDPA-Connecticut, UCPA-Utah, OCPA-Oregon, TDPSA-Texas, MCDPA-Montana, ICPA-Indiana, TIPPA-Tennessee, DEPPA-Delaware and ICPA-Iowa, where applicable). We will process your data to provide and improve the Services on the basis of: 1. performance of the contract; 1. legitimate interests in securing, maintaining and improving the Services and user experience; 1. your consent where required (for example, for certain analytics, personalisation, training of models with personal data); and 1. compliance with legal obligations.

    27.2. Categories of Data and Purposes.

    AI features may process account identifiers, technical metadata, content of queries and files provided by you, and interaction logs for security, auditing, debugging and quality improvement. We apply data minimisation and, where feasible, pseudonymisation. Do not request or provide sensitive data unless strictly necessary and in accordance with applicable law and enhanced safeguards.

    27.3. Providers and International Transfers.

    We may engage AI service providers and cloud computing providers, including those located outside your jurisdiction. For international transfers from the EEA/UK to third countries, we will apply valid mechanisms (e.g., Standard Contractual Clauses, Binding Corporate Rules and, where applicable, the EU-U.S. Data Privacy Framework), with transfer impact assessments and supplementary measures in light of the CJEU (Schrems II case). The list of sub-processors is maintained in the Privacy Policy.

    27.4. Data Subject Rights.

    You may exercise the rights of access, rectification, erasure, restriction, objection, portability and the right not to be subject to decisions based solely on automated processing with legal or similar effects, through the channels indicated in the Privacy Policy. You also have the right to lodge a complaint with a supervisory authority (for example, your national data protection authority). Where applicable, you may contact our Data Protection Officer (DPO) through the indicated channels. In U.S. jurisdictions where applicable, you may have the right to opt out of the "sale" or "sharing" of data or of targeted advertising.

    27.5. Automated Decisions.

    The AI features of the Services do not themselves make decisions with legal or similar effects without human intervention. Any feature with potential significant impact will include human review and oversight, greater transparency and, where appropriate, your express consent.

    27.6. Retention and Security.

    We retain data for as long as necessary for the purposes described or as required by law, applying appropriate technical and organisational measures, including access controls, encryption in transit and at rest where appropriate, logging and auditing, and periodic testing.

    27.7. Minors.

    The Services are not available to persons under sixteen (16) years of age. We do not knowingly process data of minors through AI features. The minimum age of 16 is established in accordance with Article 8(1) of the GDPR. In those EU Member States whose national legislation provides for a lower age (for example, 14 years in Spain pursuant to Article 7 of the LOPDGDD), DOMESTIKA applies the 16-year threshold as a platform policy to ensure uniform protection across all jurisdictions. If we become aware that we have collected personal data from a minor who does not meet the age requirements, we will proceed to delete or block such data without undue delay.

    27.8. AI Data Preferences.

    We will offer options to manage conversation history and exclude user inputs from use for model improvement purposes. For EEA/UK/Switzerland users, we will not use personal data for general improvement model training purposes without your prior consent, and you may withdraw your consent at any time. These preferences do not affect minimum retentions necessary for security, fraud prevention or legal compliance.

    28. AI Tutor Transparency and Security.

    28.1. Description and Transparency.

    The AI Tutor is a generative AI system that assists with content search, draft writing, summaries and recommendations. We will clearly indicate when an interaction or output has been generated by AI. You may decline its use at any time, without prejudice to non-AI-based features.

    28.2. Content and Limitations.

    Outputs may be inaccurate, incomplete or outdated; they may reflect biases present in the training data or user inputs. You must critically review any Output and not use it as the sole basis for significant decisions without additional verification.

    28.3. Security Measures and Safeguards.

    We apply reasonable measures to manage risks: filtering of unlawful content, moderation, rate limits, blocking of abuse patterns, logging and monitoring for security and quality purposes, and assessment and mitigation of material risks. Where required by law, we will carry out impact assessments (e.g., DPIAs), document the system and report serious incidents to competent authorities where appropriate.

    28.4. Professional Use and Regulated Sectors.

    The AI Tutor does not replace professional advice and does not perform clinical, legal, financial or other regulated functions. In such areas, use it only as support, with review by qualified professionals and subject to applicable regulations.

    28.5. Ownership and Third-Party Rights.

    Do not enter content whose disclosure would breach confidentiality obligations or third-party proprietary rights. You are responsible for obtaining licences or permissions for any external reuse of Outputs.

    28.6. Contact and Complaints.

    For queries or complaints about the AI Tutor, including data correction or deletion, please use the channels provided in the Privacy Policy. We may suspend or modify the AI Tutor for technical, legal or security reasons.

    28 bis. Recommendation Systems and Personalisation.

    The Services may use automated systems to recommend content, courses, projects or other features to users. These recommendation systems may be based on different factors, including: user-declared preferences; browsing or content interaction history; purchase or viewing history; the popularity or relevance of content on the platform. The purpose of these systems is to improve the user experience by facilitating the discovery of relevant content. Where technically feasible, DOMESTIKA may offer options for users to manage certain personalisation preferences within their account settings.
